Terms and Conditions

Purpose - in order to promote and encourage physical activity at Bupa Investments Ltd and use of the account in the application of Gympass and thus reward Users of the service provided by Gympass (hereinafter "Service"), the commercial entity Gympass UK LLC. with registered office in 115 Mare St, London E8 4RU, registered number 10324668 (hereinafter "Gympass") promotes the Contesting of £240.00 Gympass Membership Credit (herein after the "Contest") which will be governed by the following Terms and Conditions:

1. The period during which the Contest may be entered shall begin on 3rd August 2020 at 6:00am (Greenwich Mean Time) and shall end on 31st August 2020 at 11:59 pm (Greenwich Mean Time), both inclusive (hereinafter "Registration Period").
   
   

2. The Contest will be valid only for individuals who:

   1. Are employees of Bupa Investments Ltd (hereinafter the “Company”) during the Registration period and on the date of the Contest

   2. Have created and activated a Gympass account (through www.gympass.com/uk/bupa-uk) and are therefore registered as Users (hereinafter “User”)

   3. are 18 years old or older on the Registration Period.

   4. currently have their permanent residence in the United Kingdom and the Republic of Ireland.

Gympass, in its capacity as organizer of the Contest, will be in charge of validating that the winners have complied with the Terms and Conditions for the Contest.

3. Participation in the Contest is free of charge.
   
   

4. Mechanics of the Contest:

   1. The User must access the link sent by the Company and provide name and email address in the registration form.

   2. At the end of the registration period, Gympass will review that all participants comply with the requirement to have a Gympass account (pursuant to Clause 2.b).

   3. On 3rd September 2020 (hereinafter “Date of the Contest”), Gympass will select a winner at random using the random number generator https://www.calculator.net/random-number-generator.html on 3rd September at 12pm, who has fulfilled the criteria in clause 2 above.
      
      

5. One (1) prize (hereinafter the "Prize") of Gympass Credit  valued at £240 (two hundred and forty pounds). 

The prize may not be subject to change, alteration or cash compensation at the request of the winning participant. Prize-winning User may waive the prize obtained; however, no alternative prize will be offered. Such waiver will not give any right to reimburse or compensate.

Mechanics of the credit:

1. Once the £240.00  is credited into your account, you will then need to enroll, no later than 1st September 2025, in a plan of your choice from the available plans in the Gympass app. Failing to enroll in a plan prior to the deadline results in the loss of the right to claim the credit. 

a.       The credit can be used towards a plan of your choice (Starter to Platinum);

b.       The credit can be used for as long as it takes for the £240 to run out.

c.       It is your responsibility to check the credit balance as Gympass will NOT notify you when your credit runs out.

d.       Provided you still have credit left in your Gympass account, cancellation of a plan will not give you the right to claim reimbursement or compensation of that credit. However, the credit will remain in your Gympass account should you wish to enroll in a plan at a later date, but no later than 1st September 2025.

e.       Provided you still have credit left in your Gympass account, should you wish to pause your plan, any remaining credit will still be available to you when you decide to renew your plan in the future.

f.        You are entitled to upgrade, downgrade their plan as permitted by the app.

g. Your plan will automatically renew every month. When the credit runs out, you will be charged again at the beginning of the renewal period until you cancel or pause your plan.

h.   The credit will ONLY be deposited into your Gympass account, NOT your personal bank account. As such, the credit can only be used towards a Gympass plan.

i.  If you are already enrolled in a plan, depending on the plan chosen at the time, the cost of the plan will be discounted from the next month’s payment. (i.e if your current plan renews on the 2nd of September and you won the prize on the 6th of September. The remainder of September  will still be paid from the sum you paid in the previous renewal period (2nd of September). The credit will only apply from 2nd October onwards until the credit runs out).

j.     Your plan will automatically renew every month. When the credit runs out, you will be charged again at the beginning of the renewal period until you cancel or pause your plan.

k.     If there is credit left to only cover a partial monthly cost of the plan, you will then be charged the difference.

L.    Should you wish to NOT renew your plan for the following month or choose a different plan, you must CANCEL or change the plan AT THE LATEST the day before the plan resumes (i.e if plan renews on the 2nd of every month, you must cancel your plan no later than 1st).

7. On 7th September 2020, Gympass will notify the winner through the corporate mail provided on the registration form. If there is no contact with the User after 3 (three) attempts of communication in a period of 4 weeks, the User will automatically lose the right to receive the corresponding Prize and Gympass reserves the right to withdraw the Prize.  Once the winner's identity has been verified and the compliance with the Terms and Conditions, Gympass will add the credit to their account. The winner may be required to participate in related publicity without further reward. E.g.: be photographed for Instagram stories, provide a short statement about their win.
   
   

8. In the event that a participant has registered for the Contest but does not have a Gympass account at the end of the Registration Period, Gympass reserves the right to delete the entry of that participant and, if applicable, the winner of the Contest. In this instance Gympass will select another winner at random using the random number generator https://www.calculator.net/random-number-generator.html until a participant with a Gympass account is selected.
   
   

9. Gympass, or any of its subsidiaries, shall not be liable for any damages of any nature, whether direct, indirect and/or circumstantial, immediate or deferred, arising out of or in consequence of the use and enjoyment of the Prize.
   
   

10. Any claim or complaint may be communicated to the Customer Service Department within one month of the date of the Contest.

12. Gympass reserves the right to make any necessary modification to the Terms and Conditions in the event that, due to force majeure beyond its control, the Contest or mechanics require modification or suspension.
    
    

13. This Contest will be governed by English law. In the event of any controversy in the interpretation of these Legal Terms, both Gympass and the participants in the Contest submit to the jurisdiction of the English courts, without prejudice to the jurisdiction that by law may correspond to the consumer.
